Roger Barnett, 64, began rounding up illegal immigrants in 1998 and turning them over to the U.S. Border Patrol, he said, after they destroyed his property, killed his calves and broke into his home.His Cross Rail Ranch near Douglas, Ariz., is known by federal and county law enforcement authorities as "the avenue of choice" for immigrants seeking to enter the United States illegally.
The lawsuit is based on a March 7, 2004, incident in a dry wash on the 22,000-acre ranch, when he approached a group of illegal immigrants while carrying a gun and accompanied by a large dog.
Attorneys for the immigrants - five women and 11 men who were trying to cross illegally into the United States - have accused Mr. Barnett of holding the group captive at gunpoint, threatening to turn his dog loose on them and saying he would shoot anyone who tried to escape...
The lawsuit said he then called his wife and two Border Patrol agents arrived at the site. It also said Mr. Barnett acknowledged that he had turned over 12,000 illegal immigrants to the Border Patrol since 1998...
Mr. Barnett told The Washington Times in a 2002 interview that he began rounding up illegal immigrants after they started to vandalize his property, northeast of Douglas along Arizona Highway 80. He said the immigrants tore up water pumps, killed calves, destroyed fences and gates, stole trucks and broke into his home.
Some of his cattle died from ingesting the plastic bottles left behind by the immigrants, he said, adding that he installed a faucet on an 8,000-gallon water tank so the immigrants would stop damaging the tank to get water.
Mr. Barnett said some of the ranch´s established immigrant trails were littered with trash 10 inches deep, including human waste, used toilet paper, soiled diapers, cigarette packs, clothes, backpacks, empty 1-gallon water bottles, chewing-gum wrappers and aluminum foil - which supposedly is used to pack the drugs the immigrant smugglers give their "clients" to keep them running.
He said he carried a pistol during his searches for the immigrants and had a rifle in his truck "for protection" against immigrant and drug smugglers, who often are armed.

ReplyDeleteI suspect there's alot we're not hearing, as it all seems to be from the rancher. Isn't he impersonating an officer, or taking the law into his own hands?
ReplyDeleteRespectively, it might be more appropriate for him to observe illegal trespassers from a distance, phone law enforcement, and allow the authorities to detain the offenders. This would seem the wiser course of action to eliminate confrontations similar to the one he is being sued about.
ReplyDeleteI am a staunch proponent of border security and closing the border to illegal immigrants, and I applaud this man for wanting to assist the authorities, but when you DO decide to step in an exercise your citizen's arrest powers you must be very cautious, otherwise you might face a tort action.

Well if anyone was listening they descibed this mans yard as the avenue of choice! gee that being said as well as the 12,000 illegals he has turned in, sounds like all the information was in place for law enforcement and should have directed them to concentrate there efforts, NO ! EITHER that or start paying this guy and make him an official border patrol member, sounds like the private sector as usual is doing a better job then the government.... Now i dont know but i shutter to think illegal aliens prohibited by law here in the United States could raise a law suit against an American citizen protecting his property. Answer this he could be sued if any illegal alien were to get hurt on his property? frivolous or not it has happend in this country.Case in point the burglar that sued the homeowners after he became stuck in their garage after looting the house,he lived for like five days on warm soda and dog food he sued for duress and mental suffering and cruelty he won...frivolous ?

2) He has the right to protect his property from Vandalism Trespassers and Burlars.
These people are trespassing on his property he has the right to hold them AT GUNPOINT until the athorties arrive. If the resist or attack him I hope he pulls the damn trigger which he has the right to do.

He is the citizen of the US not them. He pays taxes not them. So I believe he should pull the damn trigger on 100 or so bet they stop crossing there.
Just think, if only he'd been around in the late 1400's, or did everybody forget that technically every non black and native american person in this country is a decendant of "illegal immigrants". In fact illegal immigrants who stole a population and brought them here against their will, then implemented a Government that had an official "extermination policy" of the native peoples of this land. Yet we as americans think we are so above people fleeing from thier own homeland in search of a better life. Huh? Sound like the fuckin Nazi! I do applaud this man for doin what he is doin, but had the Native Peoples of this land been the same way, non of us would be here! They were not Conquered, only "Conned".

ReplyDeleteI live next to the boarder of Niagara Falls, NY. In order to cross into Canada or vise versa, into New York, I have to have a Pass Port or a special enhanced license, which cost 140.00 for the Pass Port or 40.00 for the enhanced license. I will never go to Canada for that reason, however, I would love to see these illegal Mexicans try to get into Canada and try to file a lawsuit. Wake up OBAMA.....This problem needs to be fixed. When an illegal immigrant has more rights than an American tax paying citizen, I suggest we all stop paying taxes to the government and let them collect it from Mexicans.
